The following details relevant national legislation concerning migrant workers including provisions regulating the recruitment of migrant workers, measures in place for protection (such as pre-departure training, insurance schemes, etc.) and a guideline regarding sending domestic workers on foreign employment:

Foreign Employment Act 2007 ; The Act governs all matters regarding labour migration from Nepal; promotes security and welfare of Nepali workers abroad; regulates and monitors businesses facilitating labour migration, such as recruitment agencies; creates a foreign employment welfare fund; and introduces mandatory orientation training.

Foreign Employment Rules 2008 ; The Act provides rules for selecting and licensing recruitment institutions and for recruiting and sending workers abroad. It specifies the content of employment advertisements, the content of pre-departure orientation training and provisions relating to the Foreign Employment Welfare Fund.

Human Trafficking and Transportation (Control) Act 2007 ; The Act defines and prohibits acts considered as human trafficking and transportation and specifies the process of persecution and punishment. It provides for the rescue, rehabilitation, reconciliation and compensation of victims of human trafficking and transportation abroad and establishes a rehabilitation fund.

Bonded Labour (Prohibition) Act 2002 ; The Act prohibits un- or low-paid labour to repay loans (Kamaiya labour). Kamaiya labourers are freed and loans do not need to be repaid. It establishes the “Freed Kamaiya Rehabilitation and Monitoring Committee” and Welfare Officers to assist freed workers.

Guidelines Regarding Sending Domestic Workers on Foreign Employment 2015 : The guidelines include some key provisions regulating the situation of Nepali women going to the six Gulf Cooperation Council (GCC) countries, Lebanon, and Malaysia; domestic workers need to have reached 24 years of age; Nepali women ,migrating for domestic work, should not have a child below the age of two; private employment agencies of the Countries of Destination (CoDs) need to be registered at the embassy and make a deposit.
